Media Breakaway, LLC Announces Arbitrator's Award is 95% Less Than Demanded by MySpace

Westminster, CO June 13, 2008 - Media Breakaway, LLC, today announced that an Arbitrator has released a final ruling in the proceedings between MySpace, Inc. and Media Breakaway, which originated in January, 2007. The final award in favor of MySpace was 95% less than the amount demanded by MySpace, as the Arbitrator determined that "MySpace's demands are so disproportionate to proven actual damages, or Media Breakaway profits."

The Arbitrator ruled that while Media Breakaway should be held responsible for a number of unsolicited commercial bulletins sent to MySpace users in violation of MySpace's Terms of Use, the company could not be held responsible for the actions of certain affiliates who violated Media Breakaway's own affiliate terms and conditions.

"We respect the Arbitrator's findings regarding violations of MySpace's Terms of Use by certain rogue affiliates, particularly during 2006 when the concept of social networks was still developing. We acknowledged early on in this process that our Company should not profit from the sending of unsolicited commercial bulletins to MySpace users and offered to return any such profit to MySpace, and we repeatedly offered to work with MySpace to resolve mutual concerns," said Steven Richter, President and General Counsel for Media Breakaway.

Among the findings of the Arbitrator was the fact that the Company has "changed its policies and procedures over time, in dealing with affiliates...and other internet marketing issues". The Arbitrator also singled out the contributions of several key Media Breakaway team members in the development and improvement of the Company's compliance practices.

"We appreciate the Arbitrator's acknowledgement of the many steps we have taken as a company over recent years to improve our compliance practices and our methods of monitoring the activities of our affiliates," said Richter. "Our goal is to continuously enhance our compliance programs and exceed what is required by law and industry best practices."

Media Breakaway, LLC Announces Declan Dunn as Keynote Speaker for the CPA Empire® Breakaway Conference

Back in Denver

After three days in Las Vegas attending Affiliate Summit, our team has recovered and is back into the swing of things here in the office. It was great to see so many of our Affiliates and Advertisers and enjoy a few hectic days of networking and conference sessions. Missy and Shawn always put on a great event and this year was no exception.

It’s amazing to think how the show has grown in just a few short years. It doesn’t seem like that long ago when it was just a relatively small group of people getting together for the first time to talk about Affiliate Marketing. As of this year, the show has grown to nearly 3,000 attendees, 120 exhibitors and three full days of sessions and activities.

Not surprisingly, the growth of the show mirrors the growth of the Affiliate Marketing industry itself. We have seen Affiliate Marketing become a billion dollar worldwide industry with no end in sight. It’s been quite a ride so far and the next few years should hold plenty of surprises as our industry continues to evolve.

Media Breakaway Makes A Difference

During this year’s holiday season, Media Breakaway launched this new program, to provide support for charitable organizations and other groups within the local Denver community. The first part of the program included becoming involved with a local Salvation Army post in a low-income Denver neighborhood. The Company gave support in a variety of ways, including ‘adopting’ 7 local families by providing them with food, clothing, and other Christmas gifts. Media Breakaway also gave toys to well over 100 children through the combination of a Giving Tree program and additional donations that were distributed to local children. In addition, over 30 employees gave their time to help with the Salvation Army’s annual Christmas Party and gift distribution activities.

“Finding ways to give back to the community is one of the most valuable and rewarding activities that any company can undertake,” said Steven Richter, President of Media Breakaway. “We are thrilled to offer our support to the Salvation Army, helping to make the holidays a little brighter for many local families in need.”

“We believe that one of the most important aspects of our community involvement program is that it gives our employees the opportunity to donate their time and really become involved with some very worthy charities,” said Mr. Richter.

Encouraging and supporting employee involvement in the community is central to the Media Breakaway Makes a Difference program. During the holidays, George Avery, Director of CPA Empire® (a division of Media Breakaway, LLC) organized a toy drive for Denver’s Children’s Hospital. The toy drive gained wide support throughout the Company, with employees donating more than 100 toys which were distributed to seriously ill children who spent their holidays in the hospital.

Over the course of the next year, the Media Breakaway Makes a Difference program will provide support for several organizations focused on helping children and families within the Denver area. Each of these organizations is selected because they have a real impact on the community and provide opportunities for employees to get involved by donating their time and abilities.

The Media Breakaway Makes a Difference program will next be involved with Habitat for Humanity, as employees will help build houses for families in North Denver. This program will kick off in the spring of 2008.

Lucky Winners!

We recently selected winners of two great contests and wanted to announce the names of a few lucky Affiliates.

Through the Breakaway Fitness Challenge we gave Affiliates the opportunity to guess the total weight loss for all 11 of the competitors. Affiliate Linda Juliano was our hands-down winner by coming within an amazing 1 lb of the total! For her incredible guess, she will be receiving the grand prize of $1,000!

We also recently sent out the 2007 Affiliate Survey to gather valuable feedback on our current programs in order to enhance our Affiliate support in 2008. Every Affiliate who completed the survey was entered into a drawing for two iPod Nanos. Affiliates Jeff Clepper and Pawan Kumar are the proud new owners of an iPod Nano.

Media Breakaway Give Back

This past holiday season Media Breakaway, LLC and CPA Empire® took the opportunity to give back to the local community by supporting the efforts of the Salvation Army. The company provided support in a variety of ways, including ‘adopting’ 7 local families by providing them with Christmas gifts. Media Breakaway also gave toys to well over 200 children through the combination of a Giving Tree program and additional donations that were distributed to children in a lower-income Denver neighborhood.

Media Breakaway, LLC and CPA Empire® Holiday Party

This past weekend everyone at Media Breakaway, LLC and CPA Empire® gathered together for the annual Media Breakaway Holiday Party in downtown Denver.

As some of you may be aware our CEO Scott Richter and 10 of our employees (team Chubby’s Angels) were recently involved in the Breakaway Fitness Challenge – Part Deux. The final weigh-in took place on the 10th of December and both teams successfully reached their goals. However, both Scott and the Angels had some surprises in store for their respective opponents during the party.

Immediately following dinner, the Angels gathered on the stage and requested that Scott join them for a very special presentation. Scott was given a certificate congratulating him on hitting his weight loss goals along with a cape and crown befitting his accomplishment.

Not to be outdone, Scott also had something planned for the Angels. Scott announced that he had a new challenge for the Angels – in the form of a video entitled Chubby Angel’s Workout. The video, already garnering Golden Globe and People’s Choice award support in the category of Best Workout Video, held the entire crowd in a state of amazement at the incredible acting talents of its star performer – Josh Krogh. At the conclusion of the video, Scott one again congratulated his worthy opponents and presented each one with a certificate for a free massage at a local day spa.

Following the Fitness Challenge wrap-up were several special company announcements. The first was the announcement that Jenny Frederick has been promoted to Director of Product Development. Jenny has been with the company since June of 2006, as Manager of Special Projects.

After Jenny’s announcement the company’s first ever Employee of the Year award was given to Tony Bebber (Manager of the Creative Department). Tony joined the company in April of 2005 and has worked with literally every department within the company, providing outstanding support to our clients and fellow team members. Tony’s tireless efforts and work ethic are a shining example of our mission, vision and values in action.

After the special announcements, the evening’s entertainment was highlighted by Media Breakaway’s version of “Deal or No Deal”. Three employees got the chance to try their luck at winning the grand prize of $5,000 against toughest banker in the business – Scott Richter. This was the third time we had played the game (beginning at last year’s Holiday Party and then again at the CPA Empire Breakaway Conference 2007) and to date, no players had come close to breaking the bank.

The first contestant was our HR Manager, Dani Ross. Dani played a good game and eventually accepted an offer from the banker of $1,000 to become the biggest winner we have ever had in the contest. Her record only lasted until our second contestant, Affiliate Manager Jamie Stephenson took home $2,300. Although happy with his windfall, Jamie was dismayed to learn that the case he had initially selected held the jackpot of $5,000.

For the final game, Jenny Frederick was selected to take her turn on the stage. The contest quickly became interesting, as Jenny opened case after case of low dollar amounts – leaving her with several big numbers on the board, including the $5,000 grand prize. It finally came down to a last offer from the banker of $2,500 and Jenny’s shout of “No Deal!”. As the final case was opened, the entire crowd let out a loud cheer as Jenny became the first person to win $5,000!

While we everyone had a great time at our holiday party, the entire staff at Media Breakaway and CPA Empire® wishes you and your family a very Happy Holiday Season! We’ll see you again in 2008 for an even better year together filled with more fun and surprises!

The Final Weigh-In

14 weeks ago, the Fitness Challenge – Part Deux began when Scott Richter challenged 10 Media Breakaway employees to the ultimate weight loss contest. After experiencing all the drama of the first Fitness Challenge contest in 2006, fans and members of the media likely thought they would witness a similar competition this time around – a friendly rivalry, with contestants really supporting each other’s efforts, and a shining example of good sportsmanship. Little did anyone guess that Part Deux would indeed take things to a whole new level.

This year’s challenge turned into hotly contested grudge match of steadily shrinking heavyweights (all planning to become middle weights by the end of the competition), with each team unveiling radical strategies to turn the Challenge in their favor. Cheerleaders, regular deliveries of ice cream and candy, team member defections, intense paparazzi scrutiny, extreme demonstrations of devotion by fans, and other bizarre events turned a run of the mill weight loss contest into an epic battle for the ages.

As you undoubtedly know, Scott shocked Team Chubby’s Angels last week, when he hit his 15 pound weight loss goal a full week before the end of the contest. So, for the last seven days of the competition, the pressure continued to rise for the Angels. After several weeks with little progress the team put up some strong numbers at last week’s weigh-in, putting them in position to close out the Challenge with a bang.

Following last week’s weigh-in Team Scott’s worldwide fan club began a weeklong celebration, highlighted by a parade in Buenos Aires, a huge rally in London, an early start to Mardi Gras in New Orleans, and a special Monday night fish fry at the Elk’s Club in Moose Pass, Alaska.

While Team Scott fans reveled in their victory, Chubby’s Angels supporters all held their collective breaths as the minutes ticked away toward the final weigh-in. As expected, the finale was moved to Denver’s Pepsi Center, to accommodate the tens of thousands of loyal fans who wanted to witness the big event in person. Security was tight, after last week’s surprising fan appearance, but the fans all gladly walked through the metal detectors for a chance to watch their favorite competitors step on the scale for the last time.

The crowd went into a frenzy as the lights dimmed and renowned ring announcer Michael Buffer announced “Let’s get ready to weigh-in!!!!” As each competitor took the stage, fans chanted the names of their favorites. With fans from around the world watching the event on pay-per-view, one TV announcer noted, “These are the best fans in the world folks. And just remember, they aren’t saying ‘Boo’, they’re saying ‘Bo!’”

Scott stepped on the scale first and blew the crowd away by dropping even more weight for a final weight loss total of 18.6 pounds! As each of the Angels weighed in and the scoreboard showed the team’s updated totals, the tension in the stadium became almost too much to bear. Then, as the final totals were calculated all of that pressure exploded in a wave of euphoria, as the Angels hit their goal! Fans of both teams, who had been bitter rivals up until the final moments were suddenly giving each other high-fives, hugs, and the entire arena began singing “We are the champions…we are the champions…of the world!” Each of the competitors basked in the adoration and undying support of their fans – all of them winners.

One Week to Go!

With only one week left, everyone involved with the Breakaway Fitness Challenge – Part Deux is counting down the minutes to the final weigh-in. As the contest comes down to the wire, each team’s fan club is really pulling out all the stops to support the competitors.

On Friday of last week, Team Scott held a pep rally to fire up the fans and get ready for the final leg of the contest. As the rally was getting underway, one fan chose this as the moment to express his tremendous enthusiasm and unwavering support. Dressed in a homemade cheerleader outfit, this unnamed fan burst onto the stage bringing the crowd to its feet.

Clearly overwhelmed by his fan’s commitment (or his need to be committed) Scott spoke with the media following the incident. “To receive this kind of unscripted support from one of my fans just goes to show the affect that Team Scott has had on many people,” said Scott. “In recognition of his clearly exceptional team spirit, I have named this young man as my new team mascot.”

In another announcement, a Team Scott spokesman stated that security procedures during public appearances would be re-evaluated to ensure the safety of team members and overzealous fans alike. “While this incident turned out to be harmless and actually got us a new team mascot along with some great media coverage, we’re working with the Secret Service to develop a more effective protection detail.”

Chubby’s Angels spokesperson Jamie Doyle expressed concern over the incident, as well. “We all love our fans, but sometimes they can get a little…well, Looney Tunes is the term that comes to mind. This is why our security team carries tasers during all public events.”

After the excitement of Friday’s pep rally, media coverage and fan attendance jumped through the roof for this week’s official weigh-in. A hush fell over the crowd as each contestant stepped on the scale. Throughout the packed auditorium, you could hear the faint beeping of the electronic scale as the weight totals were recorded. Once the week’s results were announced, pandemonium broke out, as fans of both teams let out their pent up emotions. Many fans hurried from the stadium, ran to their cars to grab tents and sleeping bags and began forming a line for next week’s final weigh-in, knowing that this contest was going down to the wire.

Extending an Olive Branch

From the beginning, the Breakaway Fitness Challenge – Part Deux has been marked by ingenious dirty tactics and mind games, which have pushed many supporters to the brink. Over the past few weeks the contest has become even more contentious, with both teams firing off salvos at each other on a regular basis.

With tensions rising to an all-time high, Scott Richter held a surprise press conference yesterday morning to extend an olive branch to Chubby’s Angels prior to the official weekly weigh-in.

“Having monitored my worthy opponents’ performance during the last few weeks I have grown concerned over their ability to reach their weight loss goal without resorting to radical fad diets or cosmetic surgery,” said Scott Richter. “With this in mind, I am offering the Angels the opportunity to retire from the contest, without having to fulfill the obligations of the losing team.”

Reactions were instantaneous once the offer from Team Scott was announced. Fans of both teams were stunned. Vegas odds makers were in a panic, trying to decide how to account for an early ending to the contest. Various retailers and owners of Fitness Challenge themed business seemed even more worried as everyone awaited a response from the Angels. “If the contest ends early, how am I going to sell all of these Chubby’s Angels holiday snow globes?” asked one distraught store owner.

The Angels quickly gathered for a closed door team meeting to discuss Team Scott’s offer. The team emerged from the meeting room with a look of intense resolve and announced that they would not be dropping out of the contest.

“While we certainly appreciate Scott’s gracious offer, we will be staying in the contest for the duration,” said Chubby’s Angels president Jamie Doyle. “As long as I am president, no Angel will be wearing a cheerleader outfit in the office. Unless they just happen to want to dress up like a cheerleader at work one day. We have a pretty relaxed dress code, so if someone really wanted to, I suppose they could wear the outfit on some casual Friday.”

Following the announcement, the teams headed to the Official Fitness Challenge Weigh-in Room to learn whether or not Thanksgiving had affected their nutrition programs. Coming Down to the Wire

The Breakaway Fitness Challenge – Part Deux is rapidly reaching its conclusion and the pressure on the contestants continues to grow. With only a few weeks left, time is running short for the participants who aren’t already on track to reach their goals. Signs of stress are already starting to show and will likely get worse in the days ahead.

Clashes with the paparazzi have also become more and more common, as overzealous photographers hope to catch one of the contestants sneaking off to Dairy Queen for an afternoon snack or getting the value-sized fries with lunch at McDonalds. During the Media Breakaway Halloween festivities last week, several photographers dressed up in costumes to infiltrate the offices to get some candid shots of candy eating.

“We thought it was a great idea,” said one unnamed photographer. “We saw lots of people eating candy and snacks, but with all the costumes we couldn’t actually identify a single Fitness Challenge contestant. We ended up just taking pictures of everyone, until we were recognized and a confrontation with Batman foiled our plans.”

The craziness has spread across the internet, as well. Recently a half-eaten donut was put up for auction on eBay that the owner claimed was the remains of a snack session by one of Chubby's Angels. When asked which Angel the donut belonged to, he could only come up with "Sabrina, or the blond from the poster...Farrah something." Once it became obvious that the item's authenticity could not be verified, it was removed from the site.

Despite the increasingly aggressive press coverage, two of our contestants (Scott Richter and Jenny Frederick) went ahead with plans to attend an important diet and nutrition conference in New York earlier this week. While no photographic evidence has been provided, there were numerous reports of late-night poker parties and visits to the local crab leg emporium.

Interior Design at the Office

Our Affiliate Managers pride themselves on always exceeding expectations. The results of the 1st Annual CPA Empire Pimp Your Cube Contest once again demonstrated that dedication. While each entry was unique, it took the celebrity judges very little deliberation when it came time to select a winner.

Shane Graper’s entry gave new meaning to Southwestern décor. Shane’s recreation of an authentic barn (circa 1800) blew away the competition. The judges raved about his use of an authentic hay bale and horse saddle to evoke the feel of the old west, along with more modern touches – like a cowboy screen saver.

During the award ceremony, Shane was asked about his design inspirations and what made him come up with such an outlandish display. “Basically, I just brought a few items from my living room. Hay bales make great end tables,” said Shane.

The only negative reviews of the winning cubicle came from the building cleaning crew, who found bits of straw and hay trailed throughout the office.

Bolder Boulder 10K Race

On Memorial Day, May 28th, 12 members of the Media Breakaway team participated in the 29th annual Bolder Boulder 10K race. The group joined over 45,000 runners from around the world for this Memorial Day tradition.

Each Media Breakaway runner prepared for the race by enduring an intense training program, designed to produce record-breaking results. For the past six months, each racer has begun their day by running to work each day. Treadmills were installed in every office and conference room throughout the company headquarters – allowing racers to train while attending meetings. Team members also wore pedometers at the office and ran to meetings, co-worker’s offices, the cafeteria, etc. While a few hallway collisions did occur, this was a small price to pay for the immense benefits this training provided. As race day approached, each runner was at the top of their game, focused on victory.

Despite all the rigorous training, Media Breakaway team members failed to capture either the women’s or men’s titles. World class runners Edna Kiplagat of Kenya and Ridouane Harroufi of Morocco emerged victorious over the intrepid MB racers to take home the awards.

“I had the race in the bag,” said Jenny Frederick. “I was pulling away from the field and felt totally confident after the first hundred yards or so. But, somewhere after that first block, I apparently made a small tactical error and the eventual winner must have passed me just before the finish line.” In the final results, Jenny finished approximately 30 minutes behind the women’s leader.

Steve Kilberg also felt that he missed out on his chance at racing immortality. “My alarm clock didn’t go off in the morning, so I was late getting to the race,” said Kilberg. “I arrived just in time to start the race, with no time to stretch. The lack of prep time cost me a chance to win.” Similar to teammate Jenny Frederick, Kilberg finished the race in just over double the time of the men’s winner.

While the team didn’t win the title, each member felt a tremendous sense of accomplishment in finishing the race. In fact, race enthusiasm was so high that Mike Fawcett, who wasn’t even planning to run, came out of the stands as a last minute participant. Mike’s effort was hampered somewhat by his choice of running shoes – flip flops. However, he made a great showing as he neared the finish line with arms outstretched in celebration.

Following the race, team captain George Avery was already hard at work planning for next year. “We need to take our training to the next level,” said Avery. “Next year, I want to bring in some hyperbaric chambers and other cutting edge training methods. We’re also looking at recruiting more employees from Kenya and Morocco.”

Congratulations to all of the Media Breakaway runners who fought through the heat and injuries to complete the race – Steve Richter, Laura Cruz, Jaz Pester, Sara D’Onofrio, Shane Graper, Steve Kilberg, Jenny Frederick, Joe Lochi, Tracey Pollard, Karen Vidick, Amanda Barry, Aimee Taublieb, and Jason Venters.

Media Breakaway Office Shootout

The Media Breakaway team took a little time out recently to tour our new building. The office is currently being renovated for our planned April move in date. During the tour, we decided to break in our new office space in true Team Chaos fashion, with the first ever Media Breakaway Office Shootout. Staff members were put into teams, with everyone getting the opportunity to shoot against Team Chaos star goaltender, Pat Avery.

After a wild contest, the winning team included Jason Venters, Holly Hein, Regina Duran, Shane Graper, Joe Lochi, and Jenny Frederick. The individual champion was Holly Hein.

Unfortunately, when the new office renovations are completed, we won’t have enough room for a permanent indoor hockey rink. However, certain team members have already been eying the large parking lot and trying to find the best possible location for an outdoor rink.

Open Letter to Affiliates and Advertisers

Dear Affiliates and Advertisers:

As most of you are aware, MySpace issued a press release in which they made allegations against Scott Richter (“Richter either phished MySpace accounts himself or acquired a list of phished accounts to launch spam campaigns”). To date, we have not been served with a Complaint nor have we seen a copy of the Complaint. As you can imagine, it is difficult to intelligently respond to a press release.

However, we want you to know that both Scott and the Company absolutely and unequivocally believe that the allegations are untrue and without merit. In fact, months ago we were contacted by MySpace and were asked to cooperate with them in identifying affiliates who were not following MySpace terms of use. We fully cooperated with MySpace and immediately terminated a few affiliates who had been identified by MySpace as violating their terms of use, as well as ours. We pledged our continuing cooperation to MySpace and never heard from them again.

We find it extremely coincidental that the press release was issued just as the media was reporting that MySpace was served with lawsuits alleging misconduct on their part which led to the physical harm of their members.

With that said, we ask for your continuing support while we wait to find out what the issues are in this case. As we believe we did not do anything improper, we will vigorously defend ourselves and let the justice system be the final fact finder, as it should.

From 2001 to 2006 we had our fair share of adversity and during that same time period we had five record breaking years in a row. And if the beginning of this year is any indicator for the rest of 2007, the success will continue for us and you, our valued affiliates and advertisers. However, one record we do not plan on breaking is honoring our contractual and financial commitments.

Media Breakaway, LLC Announces Retaining Pete Wellborn to represent the Company with regard to the MySpace complaint.

The Final Weigh-In!

Sometimes words simply fail to describe the enormity of a situation. This is definitely the case as the Breakaway Fitness Challenge comes to its conclusion. Words like excitement, tension, and drama simply do not do justice to this amazing event.

Our Fitness Challenge call center has been hard at work, fielding calls from fans around the world, everyone wanting to make sure they have the most up-to-the-minute information on the contest. Did Jenny eat the carrot cake she won at our company holiday party? Has Scott published his diet recipe book yet? Is it true that Jenny has hired a personal trainer dream team of Billy Blanks (Tae Bo), Tony Little (Gazelle Trainer), and Richard Simmons (Sweatin' to the Oldies) to help her with the last few pounds? Is the winner really going to be invited to dinner at the White House?

After the last weigh-in, our contestants each had just a few pounds left to reach the 30 pound weight loss goal. Jenny stepped off the scale with only 4 pounds to go, while Scott had only 2 pounds remaining. There has been an incredible buildup for the grand finale and today's weigh-in certainly didn't let us down.

A feverously devoted crowd began gathering late last night. With many fans willing to camp out over Christmas to make sure they had the best seats for today's final weigh-in. As Scott and Jenny were introduced, the cheering easily drowned out the announcer. However, with our contestants preparing to step on the scale, a hush fell over the crowd - the tension as thick as a slice of carrot cake.

Scott was the first to take his place on the scale. The counter showed that Scott had lost another 9.6 pounds this week for a total weight loss of 37.6 pounds! Team Scott members instantly began a raucous celebration. International team fans were able to listen to the weigh-in on a live conference call. There were immediate reports of dancing in the streets on several Caribbean islands, where Team Scott has a huge fan base.

After the crowd regained its composure, it was Jenny's turn to weigh-in for the final time. With four pounds to go this week, there was a palpable sense of anticipation. While there were certainly doubters in the crowd, Team Jenny members all seemed confident and assured. When Jenny stepped on the scale, it showed that she had lost 5.2 pounds this week - for a total weight loss of 31.2 pounds!

Pandemonium ensued as fans stormed the weigh-in area to congratulate both of our competitors. In a tremendously hard fought contest, each contestant emerged victorious. At the press conference following the contest finale, both Scott and Jenny were thrilled with the outcome.

"Team Scott has the greatest fans in the world," said Scott Richter, wiping celebratory champagne from his eyes. "Whether it was putting their physical well-being on the line in the dodge ball arena or regularly dropping off Krispy Kreme donuts on Jenny's desk, their support was amazing."

Jenny was equally excited about the contest. "I'm going to Disneyland!" Jenny yelled out in celebration. As a side note, she added "Somebody get me some carrot cake!"

Since both Scott and Jenny reached the 30 pound goal, neither will be required to perform the duties of the loser. However, early in the contest a separate challenge was issued by Missy Ward and Shawn Collins of Affiliate Summit. Discussions are underway to determine the logistics of how they will be "paying up" during the upcoming Affiliate Summit 2007 West in Las Vegas. Stay tuned for further information.

One Week to Go!

12 weeks ago, our contestants stepped on the scale for their initial Breakaway Fitness Challenge weigh-in. What started out as a friendly office contest has become a worldwide phenomenon. With fans appearing from as far away as the Caribbean, the contest has swept the globe.

It has been a whirlwind for our participants, as well. Each has been caught up in talks of book deals, TV specials, infomercials, and other opportunities. At the same time, both Jenny and Scott have developed incredibly loyal followings. Team Scott and Team Jenny members have demonstrated their support throughout the long contest, cheering on their champions at each weigh-in, whipping dodge balls at each other during a charity tournament, and doing their best to sabotage the efforts of the other team.

Through a team spokesperson, Jenny wanted to thank Team Scott members for their heartfelt holiday wishes, but asked that they please stop sending carrot cake and Harry & David baskets to her office each day.

We are down to the final week of the contest. Over the past week, Jenny has been spotted repeatedly arranging and rearranging all of the holiday candy, cookies, and cake that arrive at the office each day. She doesn't actually eat any of these holiday goodies, but seems very concerned that it looks presentable and be readily available for everyone else in the office. Is she just being incredibly organized, or is she starting to crack under the pressure?

Fitness Challenge - Down to the Wire

With only two weeks remaining in the Breakaway Fitness Challenge, our contestants are gearing up for an amazing finish. The office has been buzzing with excitement as the end approaches and both Jenny and Scott make their final push toward the 30 pound weight loss goal.

How have Jenny and Scott made such amazing progress? What diet and workout secrets have they discovered? Both contestants have traveled to a variety of destinations during the Challenge. Did Jenny find a way to incorporate BBQ into her diet during a visit to Texas? Was Scott able to find a traditional weight loss formula while in the Caribbean? Does carrot cake play a prominent role in either Scott or Jenny's diet? With a book deal and TV special in the works, representatives for both contestants refuse to give out any details.

For the past few weeks, rumors that Team Jenny has a secret plan to win the contest have been running rampant. Despite numerous questions, no members of Team Jenny would divulge any information about the plan. When asked directly, Jenny would only smile knowingly and say "Wait for the December 11 weigh-in."

A Stunning Dodgeball Victory

On Saturday, Team Jenny and Team Scott took their Fitness Challenge battle to a new level by facing off on the dodge ball court. Over 20 teams entered an annual tournament, benefiting a local Denver charity. Team Scott and Team Jenny spent the last few weeks setting up their rosters and preparing strategies in what was destined to be a grudge match for the ages.

The teams were paired up in the first round, playing a best of three games format to determine who would advance to the next round. As the players took the court, hundreds of supporters cheered on their favorites. Game 1 began with a rapid exchange of flying yellow dodge balls from each side. Sara D'Onofrio, Joey Kemp, and Kane Leins proved to be early aggressors for Team Jenny, while George Avery and Joseph Lochi returned fire just as quickly for Team Scott. As the game went on, Team Scott functioned like a well-oiled machine, with 3 players retrieving balls and feeding the 5 cannon-armed offensive playmakers.

As the first game came to a close, Team Scott captured the victory with a masterful strategic move that left Team Jenny and the entire tournament in shock. Carrying the momentum from the first impressive victory, Team Scott rolled to a win in the second game to defeat Team Jenny and move into the second round. In the end, Team Jenny's attempt to bring in ringers from outside the company proved no match for the whatever-it-takes approach of Team Scott.

The second round proved to be a tougher challenge, as Team Scott lost in a tie-breaker to 3-time defending tournament champion, Rogers Dodgers. The Dodgers had carefully watched Team Scott's first round victory and began utilizing the same strategy as the teams faced off in round 2. Despite playing against an entire team full of professional dodge ball players, Team Scott came within seconds of pulling out the win. While the team may not have taken home the championship trophy, the main goal had been achieved with a huge victory over rival Team Jenny.

Almost lost amidst the excitement of the dodge ball tournament is the fact that the Fitness Challenge is nearing its conclusion with only 3 weeks remaining. Coming into this week's weigh-in, Scott was just over 3 pounds away from hitting the 30 pound weight loss goal. Jenny remained farther back, needing to lose slightly more than 14 pounds to reach the goal.

Today, Team Jenny and Team Scott announced their lineups for the upcoming Dodgeball Tournament on December 2. Team Scott's final roster includes: Scott Richter, George Avery, Pat Avery, Tom Wozniak, Daniel Dye, Joe Lochi, Jazette Pester, and Alysha Malinaro. Playing for Team Jenny are: Jenny Frederick, Sara D'Onofrio, Tony Bebber, Joey Kemp, Jason Lancaster, Kane Leins, Dave Erickson, and Nate Youmell.

It was recently learned that one of Jenny's players is coming in from out of state to play in the tournament. Team spokesperson Sara D'Onofrio declined to comment on reports that he is actually a professional Dodgeball player, being brought in as a ringer.

Team Scott members remained unfazed by the potential use of ringers in the tournament. "We have nothing to worry about," said team member George Avery. "Several of our players were on their 7th and 8th grade dodgeball all-star teams. I'm sure those skills will all come back, once we take the court."

The two teams are scheduled to play in a first round grudge match, with office bragging rights on the line. Which team will take home the tournament trophy? The Challenge Heats Up - Caribbean Style!

The Challenge Heats Up  Support for the Breakaway Fitness Challenge continues to grow, with fans from around the world choosing sides and joining Team Scott or Team Jenny.  Taking a few days off after Ad Tech NY last week, Scott was amazed to find numerous people on the beach in the Caribbean wearing Team Scott t-shirts.  International Team Scott members were just as surprised to meet their champion in person, after following his exploits on the Internet.  "This just goes to show that our international membership drive is beginning to pay off," said Team Scott captain, Holly Heim. 

While Team Jenny has not verified any members outside the Denver metro area, rumors of an extensive underground support network are rampant.  The secretiveness and near fanatical loyalty of Team Jenny members makes it difficult to estimate their true numbers.  Recent attempts to infiltrate a Team Jenny meeting were unsuccessful, as only people who knew the team's secret handshake were admitted.

In yet another surprising turn of events, Team Jenny and Team Scott have found a new arena for their competition...Dodgeball.  An upcoming charity Dodgeball tournament will give the teams the opportunity to face off and pelt each other with large rubber balls.  Team captains Sara D'Onofrio and Holly Heim are carefully putting together their rosters in an effort to ensure victory.  Stay tuned for more information about this upcoming event.

Week #6 Weigh-In

On September 27, our competitors held their initial weigh in and kicked off the Breakaway Fitness Challenge. With just over a month completed, Scott and Jenny have shocked the nutrition and diet industry with their progress. A new diet book has been in the works for some time now and recently a camera crew was in the Media Breakaway offices to shoot footage for the accompanying video. Little did they know the drama they would witness and capture for posterity. The final scene on the video, with Jenny pleading her case to the camera crew "I can explain it! Muscle weighs more than fat! I'm telling you, muscle weighs more than fat!" is available for download on various websites.

Muscle Weighs More than Fat!

Week 4 is in the books and the results are startling. Both of our contestants continued to make progress during the first three weeks of the Challenge, steadily moving toward their 30 pound weight loss goals. As the fourth week began, both Scott and Jenny faced some serious challenges. Each contestant would travel for several days during the week.

It's one thing to stay on a strict diet at home, but entirely different when you have to eat all your meals at restaurants and all-you-can-eat buffets. One of our contenders showed tremendous will power and overcame the challenges of eating on the road. Our other contestant appears to have been... less successful.

Which competitor stayed focused on the Challenge despite innumerable temptations? Which contestant ate birthday cake over the weekend? Who keeps pointing out that muscle weighs more than fat? We're Getting New Digs!

Westminster, CO October 17, 2006 – Media Breakaway, LLC, an industry leader in online direct marketing today announced plans to move their corporate offices to a new location.

“This move is an important and exciting step for our company,” said Steve Richter, President of Media Breakaway. “Our current offices have been a great home for the company as we have grown from a small startup to our current size, having over 40 team members and several business divisions. The new location will give us tremendous flexibility to design a space that meets our needs today and can accommodate our continued growth in the years to come.”

The new building is located near Pecos Street and W. 121st Avenue, Westminster CO, which is within view of the current Media Breakaway headquarters. Keeping the office in the same general area was an important factor in selecting this new location.

“We definitely have strong ties to this community, with many of our team members living very close to the office,” said Scott Richter, CEO of Media Breakaway. “We made sure to consider the needs of our staff along with our company objectives, when we began looking for a new location. The new offices really provide us with the best of both worlds.”

Media Breakaway’s new headquarters will have over 10,000 square feet, with additional space available as the company expands. The building also provides a workout room and other amenities

The company is currently working on design plans for the new office space and team members are expected to begin moving in as early as March, 2007.

The third week has come and gone in our Breakaway Fitness Challenge. In week two, our competitors continued to make great progress, with Scott losing 4 and Jenny dropping 3.6 pounds. Diet and nutrition experts have been calling all week trying to learn our contestants' secrets. With a potential diet book deal in the works, the pressure is on to keep dropping the pounds in the weeks ahead.

Six New Additions to our Family

Westminster, CO October 10, 2006 – Media Breakaway, LLC, an industry leader in online direct marketing today announced six additions to the company. The following people have recently joined the company; Amanda Barry – Corporate Counsel, Doug Davis – Affiliate Manager, Jason Lancaster – Manager of CPA Empire, Matt Sais – Billing and Collection Specialist, Beaudon Spaulding – Director of Offline Data Marketing, and Aimiee Taublieb – Project Manager.

“We are excited to bring on so many highly talented and enthusiastic people to our team,” said Steve Richter, President of Media Breakaway, LLC. “As we continue our rapid growth, each new team member will play an important role in our future success.”

As Corporate Counsel, Amanda’s role is to ensure legal compliance with all business initiatives, implement strategic legal policies, negotiate agreements and handle employment matters for the company.

Doug joins our outstanding group of Affiliate Managers. In this role, Doug acts as the key day-to-day contact for a number of CPAEmpire Affiliates. He has already begun assisting his affiliates to grow their businesses and is receiving rave reviews for his client service skills.

In the role as Manager of CPAEmpire, Jason will manage all of the Affiliate Managers and help them provide even higher quality service to their Affiliates.

Matt has joined the accounting department as Billing and Collection Specialist. In this position, Matt will be responsible for preparing customer billing, investigating billing issues and verifying charge accuracy.

As Director of Offline Marketing, Beaudon will be taking a leadership role for a new division of the company, focused on providing another effective marketing resource for Media Breakaway advertisers and other clients.

Aimiee has taken on the position of Project Manager and will be working on a wide variety of projects and initiatives designed to enhance the company’s services.

"Team Scott Takes the Lead"

WESTMINSTER, CO.- October 4, 2006 – Scott Richter, CEO of Media Breakaway, LLC, takes the lead in the Media Breakaway Fitness Challenge.

After their first week in the Media Breakaway “Fitness Challenge”, Scott Richter and Jenny Frederick are getting a taste of what they’ve actually gotten themselves into.

When our two contestants signed up for this challenge, they both knew that above anything else they wanted to lose the weight and be healthier. Little did they know that what was supposed to be a simple contest would manifest into an Extreme Competition that seems to have taken on a life of its own.

On Monday, October 2nd, officially one-week into the contest, both Scott and Jenny had to step on the scale for the first time and face the reality of their situations.

“Scott’s been working out like a mad-man and I’ve been helping by cooking him healthy dinners at night. I’ve already lost 5 pounds because of this competition and I’m not even participating,” said Steve Richter, President of Media Breakaway, LLC and spokesperson for “Team Scott”.

“We’ve got the momentum going. Jenny’s been at the gym 3 hours a night mixing cardio with strength training,” said said Sara D’Onofrio, CPAEmpire.com Affiliate Manager and spokesperson for “Team Jenny”. “Scott’s been a little cocky about winning so we are planning to use his over-confidence to our advantage.”

Scott put on an impressive show out of the gate with a 12 pound weight loss in just one week. Jenny’s drop was equally remarkable, clocking in at 6 pounds.

Both participants say they are prepared to give 100% during this competition, but are admitting that the combination of the diet, work out schedule, and the pressure of the contest itself, is definitely a challenge.

So “Team Scott” is ahead right now but the Media Breakaway Fitness Challenge is just beginning.
